      When it comes to our homes, we believe most homeowners think alike. We are primarily concerned with future property value and quality of life, and know that the condition of our neighbors homes will have a direct affect on our goals. The Association is the means to this end, of course an association is of no value unless the Conditions Covenants & Restrictions (CC&Rs) are enforced with consistency. That is where we at Homeowners Association Management come in.

    If your community is to reach its full potential, each member must contribute to the task. Obviously, when neighbors are living in such close proximity, there must be enforceable rules. Your CC&Rs, to which each of you have agreed by the purchase of your home, are the governing documents. We suggest that you find the time to read through your copy of the CC&Rs to understand your responsibilities as a home owner and spare yourself unnecessary frustration in the future. Where CC&Rs and City Code differ, the more restrictive will apply. We will be happy to answer any questions you may have concerning the CC&R restrictions.

    Please do not take offense if you receive a Courtesy Notice. We do not expect you to be an expert on the rules. Therefore the first notice is intended to be friendly but informative. We believe that most homeowners want to be part of the solution rather than the problem and just need a little clarification and direction.

    If you intend to rent your property you are required to provide us with your current mailing address and phone number and if applicable, the mailing address and phone number of your property manager. Our inability to contact you for billing or to correct a discrepancy may result in additional charges.

    We know that it takes time for new homeowners to adjust to the controls placed on them by CC&Rs. Please understand that your HOA Board members will do their best to work with you to resolve a discrepancy without conflict. However, your HOA Board must enforce the CC&R requirements in the best interest of the entire community. In those cases the current CC&R Enforcement Policy will be applied. Additionally, your HOA board is empowered with the authority to incorporate new rules from time to time that are consistent with the provisions of the current CC&R. Updates to the Rules & Policies, when applicable, will be provided to each member.

Architectural Control Committee

    The purpose of the Architectural Control Committee (ACC) is to protect the substantial investment you have in your home. All action taken by the ACC is intended to ensure property values remain as high as possible and to provide for an aesthetically pleasing and safe environment for your family and guests. In the event you receive a Notice, your prompt response with corrections will benefit the entire community.

    The ACC exists to help ensure consistent application of design criteria and requirements included in the CC&Rs and architectural guidelines for both new and existing homes. All proposed exterior additions or changes to homes or landscaping must be reviewed and approved by the committee in order to protect the homeowner from the possible requirement of rework or demolition of improvements. Some examples include placement of a storage shed, fencing, or significant change to the landscaping in your yard. Satellite dishes do not require prior approval but must meet the requirements noted below. This procedure is designed to protect your neighborhood from deterioration and decline.

    Requests for ACC Approval should be submitted via your website at theislandshoa.com. Please allow 30 days after submission of an acceptable form for a decision from the ACC.

    We understand the confusion that accompanies moving into a new home. Therefore, allow us to take this opportunity to provide a quick overview of some of your CC&R requirements. This letter is NOT intended to replace the CC&Rs, but only to help clarify. The governing legal document over association affairs is the Master Declaration of the CC&Rs.

CC&R OVERVIEW

1. Landscaping/Buildings, per Sec. 5.26. Front yards must contain, as a minimum, automatic sprinkler systems and sod, shrub beds, 4-5 gallon & 8-1 gallon plants (flowers do not apply) and one tree. Berms and sculptured planting areas are encouraged. Sheds must conform to the materials and colors of the residence and require ACC approval prior to construction.

2. Fences, per Sec. 5.25, may not be installed nearer to the street than the front corner of your home. Fence setbacks on street side of corner Lots will vary dependent on neighboring Lots and shall be determined by the ACC. It is the Owners responsibility to receive ACC approval and obtain a City Building Permit for all fences.

3. Vehicles, per Sec 5.19 & 5.27 (f). Street parking is prohibited. Gravel driveways or RV accessways are prohibited. Trailers, boats, motorcycles, motor homes, trucks larger than standard pickups, tractors, campers, garden or maintenance equipment, inoperable vehicles, vehicles other than automobiles, when not in use, shall be kept enclosed at all times in an approved structure, or screened from the public view by an approved fence.

4. Animals (Sec 5.10). A maximum of two (2) pets may be kept on each Lot. Pets that are dangerous are prohibited. Dog runs shall be positioned behind the residence in a manner least noticeable to the neighbors, screened from view by a 6 foot privacy fence and a minimum of 36 inches from your Lot line. Animals may not be tied in the front yard for any reason. Animals that stray off of your property and barking dogs are a violation of City Code and complaints will be directed to the authorities.

5. Antennas (Sec 5.22). TV antennas/satellite dishes may be installed according to ACC requirements. If you have any questions concerning placement of antennas, please notify the ACC to allow for inspection/approval of location prior to installation. Guidelines are a minimum of 20 foot back from the front of the home with best effort to conceal from view. Placement contrary to the CC&Rs will be subject to being moved at the Owners expense. Dishes larger than 20 inches in diameter must not be placed on your roof.

6. Maintenance (Sec 5.27). Trash containers, bags, mowers or other items or equipment that are not a part of your landscaping must be stored out of sight of the public. All improvements on a Lot shall be maintained in good condition, oil stains regularly cleaned from driveways, fences sealed, lawns mowed and trimmed weekly and weed & feed applied regularly, shrubs kept trimmed and beds weeded, irrigation watering adjustments made regularly as temperatures fluctuate to ensure against excessive runoff.
